Terms & Conditions 2009

 

The Terms and Conditions below shall apply to all Services supplied by Seek-it ltd unless previously agreed.

Legal Compliance & Insurance

    Seek-it ltd provides award winning eco-friendly recycling services for discarded Electrical and Electronic Equipment along with other types of e-waste.

    The WEEE Regulations 2006, The Hazardous Waste Regulations 2005 and The Environmental Protection Act 1990 (Duty of Care Waste) are fully embedded into all core recycling services we provide.

    We operate a modern, secure licensed WEEE ATF (Approved Treatment Facility) which is also a registered WEEE AATF (Approved Authorised Treatment Facility). As part of terms of our Waste Management Licence the Blueprint facility is subject to regular inspections by the Environment Agency. The results of these inspections are public record; Seek-it has maintained a 100% record since opening the facility in 2005.

    The WEEE Regulations 2006 place new responsibilities for non-household users (B2B) of electrical and electronic equipment (EEE) at the time of disposal. The most important obligation is that all discarded EEE must be treated in a licensed WEEE ATF (regulation 36).

    In accordance with the WEEE Regulations, our WEEE recycling services are fully compliant with Regulations 24 (Prioritise re-use), 25 (Treatment Standards) and 26 (Material Recovery Rates).

    Certain EEE recycling may introduce the Data Protection Act 1998 due to information held on magnetic media. Our service includes all necessary measures to ensure complete compliance with the Data Protection Act at all times

    Seek-it are licensed by the Environment Agency to transport 3rd party waste

    Electronic copies of all licences, insurance policies and other company accreditation such as ISO certificates and environmental awards can be downloaded from here.

    Our Public Liability Insurance policy provides cover up to £5,000,000. (Axa Insurance UK PLC, Policy: 124/311343P1

1). Equipment & Items discarded by the customer:

    Health & Safety
    1. Please provide advance notice of any site specific Health & Safety practices you wish to us to follow such as the use of PPE, No Mobile policy, etc when working on your premises or site.
    1. Ensure the equipment is stored safely within a confined area with ample access to a clear exit route from your building.
    1. Please stack all discarded items safely in a dry area. Items in any of the following conditions present additional handling and safety risks and may incur additional disposal charges.
        1. Wet
        2. Smashed or burnt
        3. Broken monitor tubes
        4. Toner, Battery acid
    1. Ensure that any equipment known to present an electrical (or any other) risk is clearly marked.
    1. Advise us when individual items are heavy (over 30kg), bulky (over 50cm width) or oversize (exceeds 1.5m in length/height).
    1.   The customer will ensure all item marked for disposal are supplied in a reasonably clean state and where appropriate empty of non-WEEE materials such as paper, foodstuffs and other organic matter. An additional handling charge may be applied to contaminated equipment.
    1. Seek-it will only accept discarded WEEE & E-Waste from a customer that meet our waste acceptance criteria. Seek-it maintains the right to reject consignments contaminated with hazardous substances such as asbestos.

      Should hazardous contamination be detected during preliminary inspection at our facility the customer will immediately be advised. 

      In the case of Hazardous contamination the customer will be financially liable for 100% of subsequent disruption, decontamination and disposal charges.

2). Collections

    Service Orders

    1. Please use the on-line secure Customer Area to place all service orders. Place separate orders if you require collections for multiple sites; combined collection charges will be adjusted automatically in the final invoice.
    1. Please allow a minimum of 5 working days notice when ordering a non priority collection. We will endeavourer and in most circumstances will collect on the date nominated by you in your collection request; however this level of service is not guaranteed unless you have ordered a priority service.
    1. We will provide email confirmation of the nominated collection date a minimum 72 hours before the actual collection. You will receive a combined Collection & Waste transfer note informing you of the date/time period of the collection. Driver, mobile phone and vehicle details are also included for security purposes. Please print a copy and present to our driver during the collection.
    1. Please provide full contact details for the person responsible for the on-site disposal operation.
    1. Collection dates may be changed or cancelled without incurring additional charge up to 9:15 am on the day of collection. Cancellations or postponements made after this time may incur a collection charge as set out in Failed Collections below.
    1. Please give us prior notification if ID is required to enter your site.

    Failed Collections

    Seek-it carries out recycling collections weekdays between the hours of 9:00 am to 4:30PM unless previously arranged.

    A failed collection is triggered when Seek-it arrives at your site on the agreed date but is unable to collect the consignment due to any of the following:

    1. No Access to site/premises.
    2. Denied access to site/premises by customer.
    3. No access to the consignment storage area.
    4. Site contact is unavailable, collection cannot proceed.
    5. Consignment is not ready for collection.
    6. Consignment is significantly different from the service ordered (condition, dimensions or quantity).
    7. Consignment is stored in an unsafe manner which may put Seek-it personnel or other people at risk.
    8. Unsafe route from consignment storage area to our vehicle.
    9. Cancellation or postponement request after 9:15 am on the day of scheduled collection.

    In the case of a failed collection Seek-it may apply an additional collection fee.

3). Deliveries

    We accept deliveries to our facility in Portsmouth, Hampshire. Please use the Customer area to arrange a delivery.  Currently we do not charge a gate fee for customer deliveries.

    1. Items in any of the following condition present additional handling and safety risks and may incur additional disposal charges.
        1. Wet
        2. Smashed or burnt
        3. Broken monitor tubes
        4. Toner, Battery acid
    1. Ensure that any equipment known to present an electrical risk is clearly marked.
    1. The customer will ensure all item marked for disposal are supplied in a reasonably clean state and where appropriate from non-WEEE materials such as paper, foodstuffs and other organic matter.

4). Destruction of information held on Magnetic Media

    Prior to recycling some equipment requires additional procedures to ensure full compliance with the Data Protection Act and prevent unauthorised data disclosure. Our prime function is to protect our customers by preventing data protection breaches at all times.

    Data destruction is carried out using a variety of industry standard methods such as multiple overwrites (software), degaussing and physical destruction. Our systems support various international data purging standards such as SEAP, US DOD and HMG Infosec Standard No.5.

    1. We guarantee that all magnetic media we receive will have all residual data removed permanently.

      Please note: There is no requirement to book this service as data destruction is carried automatically without additional charge.
    1. Certification of the destruction process can be ordered should it be required, please see section 5 below.

5). Reporting & Certificates

    Seek-it provides a variety of reports to ensure that that your organisation can demonstrate that WEEE & E-waste disposals are carried out responsibly in full accordance with the law.

    We also offer supplemental reports aimed towards organisations that require enhanced information such as data destruction certification and Asset+ inventory reports that detail Make, Model, and Serial & Asset Numbers etc. Supplemental reporting is subject to extra cost and may be added at the time of order.

    Please note: Waste Notes and Hazardous Waste Consignment Notes should be retained for a minimum 6 years.

    1. All recycling services include Standard Reporting at no extra charge.
    1. Asset+ Inventory reporting can be added to any order at any stage prior to collection.
    1. Data Destruction certification can be added to any order at any stage prior to collection. In some cases we may be able to provide historic certificates that were not ordered by the customer at that time; however this is subject to data availability and a supplemental charge.
    1. Dupicate certificates and reports are available to download from the secure customer area at any time. There is no charge for this service.

6). Recycling & Waste Treatment

    To ensure your waste does not contribute towards landfill, recyclate and residual from our WEEE demanufacture process are sent to selected 3rd party organisations for further environmentally friendly treatment and material recovery. All our treatment partners are fully audited by us and are authorised by all relevant authorities.

7). Charges and payment

    Seek-it charges for all equipment and waste received from a customer in accordance with their current payment structure (Payplan). Your current Payplan can be reviewed on-line in the customer area.

    Seek-it provides a disposal note every time our service is used to record the amount of discarded equipment & e-waste received from the customer. The note is agreed and signed by both parties and is then used to calculate the final invoice.

    1. The customer shall pay the recycling charges as stipulated in Payplan and in accordance with quantities agreed in the Disposal note.
    1. On occasions errors on the amount of discarded WEEE reported on disposal note may be discovered during primary check-in at our facility. In these cases we will contact you by email within 48 hours of the collection and advise you of the discrepancy. Additional items will be charged in accordance with your Payplan; likewise shortfalls will be deducted from the final invoice at the rate stipulated in Payplan.

    Situations where Disposal Note discrepancies may occur include:

    1. Equipment supplied with multiple hard drives or none
    2. Hard drives, batteries, hand held equipment and other chargeable items supplied in mixed WEEE boxes or other containers.
    3. Counting inaccuracies when loading the vehicle or at the time of delivery

    The final amount for our services will include where appropriate;

    1. Hazardous Waste Note Consignment Fee
    2. Collection charges
    3. Charges for supplemental reporting options such as Asset+ and Data Destruction Certification
    4. Any additional charges relating to failed collections, handling charges due to contamination or poor condition
    5. Charges for additional services contracted such as on-site data destruction, container rental, on-site decommissioning, out of hours service etc

    VAT @ 15% will be applied to the final price

    1. Unless agreed otherwise, Seek-it will invoice the customer upon delivery or collection of discarded WEEE and E-waste from the customer. The customer agrees to pay that invoice in full within 30 days of the date of issue. 30 day payment option is subject to prior approval.
    1. All invoices will be sent by email to the person nominated as the billing contact during the account registration process. Copy invoices can be downloaded from the customer area at any time.
    1. In the event of late payment, Seek-it may apply interest charges on the outstanding balance at the rate of 5% above the Lloyds Bank PLC base lending rate. Interest may be applied from invoice due date until full payment is received.

8). Title & Risk

In order to provide maximum protection to the customer Title and Risk of all discarded WEEE and E-Waste shall pass to Seek-it ltd upon completion of the collection phase at the customer’s site or on receipt of delivery.

Transfer of Title & Risk is subject to the consignment meeting our waste acceptance criteria. See Section 1, Health & Safety.

9). Information & Privacy

We are registered Data Controllers under the Data Protection Act (Registration Number: Z8389849). Our full Privacy Statement can be found on our web site and a printed copy available on request.

  1. Any information held by us about your organisation and its employees will only be used for internal purposes only and will not be shared with any 3rd party without your explicit permission.
  1. All electronic data held about you and your organisation is held on a secure server protected against un-authorised external access.
  1. Seek-it may from time to time send emails to registered customers to provide legislation updates, changes to terms and conditions and to raise awareness of improvements and additions to our service range.
  1. As a further measure to protect customer anonymity all labels and other indentifying marks found on discarded equipment are removed as part of our recycling process

10). Dispute resolution

We always try our best to provide an efficient, friendly and professional service at all times. In the unlikely event a dispute should arise Seek-it will always commit maximum resources to resolve the situation as expediently as possible.

Should any dispute not be resolved to the complete satisfaction of both parties a third party expert (“the Expert”) will be appointed to perform as Expert and not as arbitrator.

The Expert shall be appointed by mutual agreement or, failing that, within 14 days after by written request from either party to the other. In this case the Expert will be appointed by a neutral person at Chartered Institute of Arbitrators.

The Expert shall have the same powers to require any party to produce any documents or information to him or to the other party.

Decisions of the Expert shall, in the absence of fraud and/or manifest error, be final and binding and not subject to appeal.

The fees of the Expert shall be borne by the parties as the Expert may direct.


These Terms & Conditions are governed by English Law and the courts of England and Wales shall have non-exclusive jurisdiction.
