Producer Compliance Scheme WEEE Service Overview

When the UK WEEE regulations eventually appeared in December 2006 the overall implications did not seem overly onerous for B2B producers.
Unfortunately 2 myths were created:

  1. Both scheme and member could achieve compliance simply by transfering the responsibility to finance collection and treatment costs to the end user, job done.
  2. Producer Compliance schemes could step back to a reporting role only where B2B producers set up their own systems.

In mid Febraury 2007 the Environment Agency made their stance clear which they continue to reinforce since: They expect Producer Compliance Schemes to put in place tangible systems to ensure that B2B Members do all they can to meet their regulation 9 obligations.

The Agency intend to audit Producer Compliance Schemes to ensure they operate in accordance with their Operational plan, Constitutution and Conditions of Approval.

Part of the audit will focus on whether a scheme :

  1. Has the necessary resources and systems in place to discharge its obligations in an appropriate and timely manner.
  2. Posesses viable plans to collect an amount of WEEE equivalent to that which it is responsible for financing under these Regulations.
  3. Verfies that re-use and treatment carried out by producers or end users is in accordance with the WEEE regulations and that effective return mechanisms are in place and easily assessible.
